These Terms of Use (“Terms”) govern your access to and use of the ParadICE mobile application and website (the “Services”) operated by ParadICE (“we,” “us,” or “our”). By using the Services, you agree to these Terms.

Eligibility

You must be able to form a binding contract under applicable law to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Services

ParadICE provides the Services for your personal or authorized use. Features may change over time as we improve, update, or discontinue parts of the experience. We may modify or suspend the Services with or without notice, where permitted by law.

Accounts

If an account is required, you are responsible for maintaining the confidentiality of your credentials and for activity that occurs under your account. Notify us promptly if you believe your account has been compromised.

Acceptable use

You agree not to:

  • Use the Services for any unlawful purpose
  • Attempt to interfere with or disrupt the Services, servers, or networks
  • Reverse engineer, scrape, or probe the Services except where such restriction is prohibited by law
  • Misrepresent your identity or affiliation when communicating with us

Intellectual property

The Services, including design, text, graphics, and trademarks, are owned by ParadICE or our licensors and are protected by intellectual property laws. These Terms do not grant you ownership of any part of the Services. You may not copy, modify, distribute, or create derivative works based on the Services except as expressly allowed by us or by law.

Purchases and subscriptions

If paid features are offered through the Apple App Store or another platform, billing, renewals, refunds, and cancellations are handled according to that platform’s terms and policies, in addition to any terms presented at purchase.

Disclaimer

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR FREE, OR COMPLETELY SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARADICE AND ITS TEAM WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Termination

We may suspend or terminate access to the Services if you violate these Terms or if we discontinue the Services. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.

Privacy

Our handling of personal information is described in our Privacy Policy.

Changes

We may update these Terms from time to time. We will update the “Last updated” date when we do. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
